Magnitsky’s Colleague Sues the Russian Authorities to Compel them to Investigate Interior Ministry Officer Artem Kuznetzov and Lawyer Andrei Pavlov for Their Role in the Conspiracy to Steal $230 Million That Magnitsky Exposed

On 14 Decem­ber 2012, the Bas­man­ny Dis­trict Court of Moscow will hear two law­suits filed by Jami­son Fire­stone, the for­mer law part­ner of Sergei Mag­nit­sky, seek­ing to com­pel the Russ­ian author­i­ties to inves­ti­gate his pri­or com­plaints regard­ing the evi­dence of illic­it enrich­ment of the fam­i­ly of Inte­ri­or Min­istry offi­cer Artem Kuznetsov, and the role of lawyer Andrei Pavlov in court pro­ceed­ings that were used to per­pe­trate the enor­mous fraud uncov­ered by late Sergei Magnitsky.

The first law­suit states that a pre­vi­ous­ly filed com­plaint by Fire­stone seek­ing an inves­ti­ga­tion into the illic­it enrich­ment of the fam­i­ly of Inte­ri­or Min­istry offi­cer Artem Kuznetsov, was attached with­out a rea­soned ground to a Magnitsky’s death case opened into uniden­ti­fied prison ser­vice officials.
“The inves­ti­ga­tor did not have rea­sons to attach to this case the Firestone’s report seek­ing an inves­ti­ga­tion into the Inte­ri­or Min­istry Offi­cer Kuznetsov’s con­duct against the inter­est of pub­lic ser­vice,” said the complaint.

The sec­ond law­suit states that Jami­son Fire­stone was noti­fied that his com­plaint seek­ing an inves­ti­ga­tion of the state cov­er up of the crim­i­nal con­spir­a­cy to steal $230 mil­lion that Sergei Mag­nit­sky had exposed was for­ward­ed for a probe to the Inte­ri­or Ministry’s Inves­tiga­tive Depart­ment in the part con­cern­ing lawyer Andrei Pavlov. More than ten months lat­er, no find­ings or con­clu­sions of the probe have been issued. “On 21 May 2012, a request was sent inquir­ing of the results of probe in the part con­cern­ing A.A. Pavlov giv­en that over four months had elapsed since the date of the application…Until today, no infor­ma­tion has been received on the results of the probe,” says the lawsuit.

The court hear­ings are sched­uled for noon and 2 pm on Fri­day, 14 Decem­ber 2012, and will be presided by judge Natalia Mushnikova.
Last year, Judge Mush­niko­va refused the law­suit by Magnitsky’s moth­er seek­ing access to her son’s tis­sues and organs. Because the Russ­ian author­i­ties have refused to grant access to the tis­sues archive, Magnitsky’s fam­i­ly has not able to car­ry out an inde­pen­dent med­ical eval­u­a­tion three years since Magnitsky’s death.
