Last Words by Sergey Mag­nit­skiy in Russ­ian Court Reveal Human and Legal Rights Abuse

20 Novem­ber 2009 – The last words by lawyer Sergey Mag­nit­skiy, made in a Russ­ian court, reveal vio­la­tions of his legal and human rights in breach of the Euro­pean Con­ven­tion for the Pro­tec­tion of Human Rights and Fun­da­men­tal Free­doms and Russ­ian law.

In his last pub­lic state­ment, Sergey Mag­nit­skiy named the vio­la­tions of Arti­cle 3 of the Con­ven­tion – “Pro­hi­bi­tion of tor­ture” – that states that “no one shall be sub­ject­ed to tor­ture or to inhu­man or degrad­ing treat­ment or pun­ish­ment,” and of Arti­cle 6 – “Right to a fair tri­al” – that spec­i­fies the right for “ade­quate time and facil­i­ties for the prepa­ra­tion of his defence”. He accused the court of con­don­ing these vio­la­tions and refus­ing him his basic human dignity.

THE TRAGIC DEATH OFTRUE HERO: Condolence book to honor the life of Sergey Magnitskiy

On Mon­day, 16 Novem­ber 2009, Sergei Mag­nit­skiy, 37, who brave­ly exposed mas­sive cor­rup­tion by Russ­ian Inte­ri­or Min­istry offi­cials, trag­i­cal­ly passed away at a Moscow prison where he was kept for a year with­out tri­al. He left a wife and two children.

Please hon­or this great man by express­ing your con­do­lences, and show the world that Sergey Mag­nit­skiy, and what he stood for, will nev­er be forgotten.

Соболезнования в связи с трагической гибелью Сергея Магнитского, человека чести и великого достоинства

В понедельник, 16 ноября 2009 года, в следственном изоляторе «Матросская тишина», в Москве, трагически скончался Сергей Магницкий, 37-ми летний адвокат, отдавший свои силы, здоровье и жизнь борьбе по разоблачению масштабной коррупции в рядах МВД России. За несгибаемую волю, принципиальность, человеческую порядочность следователи держали Сергея в тюрьме в течение года. У него остались жена и двое детей.

Пожалуйста, почтите память этого великого человека, выразив соболезнования (в комментариях ниже) и уважение Сергею, его семье и близким, а также делу, за которое он отдал свою жизнь. Pros­e­cu­tor Office Denies an Inde­pen­dent Med­ical Exam­i­na­tion into the Cause of Death of Sergey Magnitskiy

19 Novem­ber 2009  –  The lawyers of Sergey Mag­nit­skiy have been informed that the Moscow Pros­e­cu­tor Office reject­ed a request for an inde­pen­dent med­ical exam­i­na­tion into his death.

Sergey Mag­nit­skiy died on 16 Novem­ber 2009 in a Moscow prison, where he was kept with­out tri­al for 12 months. His moth­er request­ed an inde­pen­dent med­ical exam­i­na­tion into the cause of death of her 37-year old son. The appeal was made by lawyers to the Pre­o­brazhen­sky dis­trict of the Moscow Pros­e­cu­tor Office.
