Posthumous Prosecution of Sergei Magnitsky is Moving Forward In Spite of Massive Falsifications; Lawyers are Forbidden to See the Case File

On the eve of the third anniversary of the death of Sergei Magnitsky in Russian police custody, the Russian Interior Ministry has announced that it has completed its investigation and prepared the case file for an imminent trial. The proceedings in relation to Magnitsky, who has been dead for three years, will be the first case of a posthumous prosecution in Russian legal history.
Lawyers for Hermitage have uncovered evidence of massive falsifications of documents in the case file. They have filed 40 complaints in the last six months detailing the falsification and other legal violations, including concealment of evidence and conflict of interest, but all complaints have been rejected by the Ostankinsky District Court and the Federal Interior Ministry on unreasoned grounds. Following these complaints, the Interior Ministry investigator Shupolovsky, who has been put in charge of the case, has now denied Hermitage’s lawyer any access to further materials in the case file. МВД России объявило о завершении посмертного уголовного дела в отношении юриста фонда Hermitage Сергея Магнитского и в ближайшее время намерено направить его прокурору для подписания обвинительного заключения. Это решение последовало незамедлительно после заявлений адвокатов Hermitage, ведущих ознакомление с делом, об обнаруженных ими фальсификациях следствием материалов уголовного дела, которое на всем протяжении велось с грубейшими нарушениями уголовно-процессуального закона, с целью сокрытия истинных причин незаконного преследования Сергея Магнитского. Следствие также запретило адвокатам дальнейшее ознакомление с материалами дела, пытаясь скрыть иные нарушения. Действия следователя МВД Шуполовского, сменившего на этом посту следователя Кибиса, были обжалованы в Генеральную прокуратуру (Чайке), Следственный департамент МВД (Алексееву) и следственную часть МВД по Центральному федеральному округу (Агафьевой).
