ЗАЯВЛЕНИЕ

1. Я, Джемисон Рид Файерстоун, гражданин США, юрист, являюсь партнером юридической и бухгалтерской фирмы «Файерстоун Данкен (Си Ай Эс) Лимитед» (далее – «Файерстоун Данкен»), членом Совета директоров Американской торговой палаты. По поручению своего клиента я также являюсь генеральным директором ООО «Анридер».
2. Я обращаюсь к Вам в связи с многочисленными нарушениями Конституции России, Уголовно-процессуального кодекса, федеральных законов и норм международного права следователями следственной группы Следственного комитета при МВД РФ при расследовании ими уголовного дела №153123.
3. Уголовное дело № 153123 объединяет в себе расследование следующих уголовных дел:
3.1. уголовное дело № 401052 (дело возбуждено 04.10.04 по признакам совершения руководителем ООО «Дальняя Степь» преступления, предусмотренного ст. 199 УК РФ; 05.05.05 прекращено за отсутствием в деянии состава преступления; 27.02.08 постановление о прекращении отменено и расследование возобновлено);
3.2. уголовное дело № 502006 (дело возбуждено 15.02.05 по признакам совершения руководителем ООО «Сатурн Инвестментс» преступления, предусмотренного ст. 199 УК РФ; в январе 2007 предварительное следствие по этому делу приостановлено по п. 1 ч. 1 ст. 208 УПК РФ, 27.02.08 приостановление отменено, расследование возобновлено и объединено с УД № 401052);

Dmitri Medvedev’s Glasnost: The Pudding and the Proof

“Conduct a swift public investigation into the torture and, in effect, judicial murder of the lawyer Sergei Magnitsky and prosecute those who ordered them. An outside counsel to Hermitage Capital Management, formerly the largest foreign investment firm in Russia, Magnitsky dared to investigate the illegal takeover of Hermitage and the bilking of the Russian state out of $230 million in a fraudulent “tax refund.” Charged, like virtually all the opponents of the regime, with “tax evasion,” he died in pretrial detention in horrible pain from pancreatitis and gallbladder disease, which the prison authorities refused to allow to be treated, in an apparent effort by the prosecution to coerce Magnitsky to commit perjury and admit guilt.25 Thus far, Medvedev has fired only prison officials. Yet, just like a “tax refund” scam on so giant a scale, the orders to torture could have come only from officials high up in the tax police, perhaps even from within the Kremlin hierarchy.”

In July 2008, Members of the Commission on Security and Cooperation in Europe (U.S. Helsinki Commission) and other Members of Congress traveled to Astana, Kazakhstan for the seventeenth Annual Session of the Organization for Security and Cooperation in Europe Parliamentary Assembly (OSCE PA). The session’s theme was “Transparency in the OSCE.” At the outset of the trip, Congressman Alcee L. Hastings, then Chairman of the Commission, remarked that while he supported the candidacy of Kazakhstan for the Chairmanship of the OSCE it was “imperative that the government undertake concrete reforms on human rights and democratization.”¹ A number of nongovernmental organizations have cited the high level of corruption in Kazakhstan as one impediment to democratic reform.
