Сегодня МВД сообщило о продлении посмертного преследования Сергея Магнитского. Преследование поручено осуществлять тем же следователям МВД, которые преследовали Магнитского при жизни.
«Генеральная прокуратура и МВД изначально незаконно присвоили себе право, которым обладают только близкие родственники, – право на возобновление уголовного дела с целью реабилитации своего близкого человека. Органы власти не только нарушили это право, но и незаконно воспользовались им для продолжения репрессии теперь в отношении родственников, безвинно погибшего человека», – сказал представитель компании Hermitage. Russian Investigator on the Cardin List Invited by President Medevedev to discuss the “Fight Against Corruption in Russia”

Yesterday, on 23rd of November 2011, Lieutenant Colonel Nikolai Budilo, who is number 23 on the US Helsinki Commission’s list of 60 Russian government officials who are banned entry into the United States for their involvement in the Sergei Magnitsky case, was invited by President Medvedev to discuss the fight against corruption in Russia.
The meeting, held at 14:00 yesterday and Chaired by President Medvedev, was held to “discuss with management and employees of law enforcement agencies, the prospective of legislation and law enforcement practices in cases against corruption”. The meeting included 24 members of Russian law enforcement agencies, including; Minister of Interior Rashid Nurgaliev, General Prosecutor Yuri Chaika and Head of Investigative Committee Alexander Bastrykin and Lt Col Nikolai Budilo, Chief Investigator from the 1st Division for investigations into organized crime from the Investigative Department of Russian Interior Ministry. Russian Interior Ministry Spits on Magnitsky’s Grave

Today the Russian Interior Ministry announced it will continue the posthumous prosecution of Sergei Magnitsky two years after his death. Calls from Magnitsky’s relatives to cease the unlawful prosecution have been rejected. In spite of this, the Russian Interior Ministry justified the extension of the posthumous prosecution by the “need to identify the position of the relatives.”
“Today’s news from the Russian Interior Ministry is hard to view as anything other than spitting on the grave of a dead man and his relatives. Magnitsky’s family has repeatedly stated their position about the illegality of the posthumous prosecution by filing formal written complaints to all Russian state bodies,” said family lawyer Nikolai Gorokhov.
Mr Gorokhov explained that complaints from Magnitsky relatives against his posthumous prosecution have been filed to General Prosecutor Chaika, Chief of the Interior Ministry’s Investigative Department Kozhokar, Chair of Tverskoi District Court of Moscow Alisov and the Moscow City Court. Read more
France Calls on Russia To Expand the List of Officials to be Prosecuted In Magnitsky Murder Case

French Foreign Minister Alain Juppe is publicly challenging the Russian government on the impunity of a number of Russian officials who were implicated in the false arrest, torture and death of Sergei Magnitsky.
In a letter from Minister Juppe to Jack Lang, a deputy in the French National Assembly and former Minister of Culture and Education, Minister questioned why only two doctors have been charged by the Russian authorities in spite of the findings of the Russian Human Rights Council which names officials in the Interior Ministry, General Prosecutor Office and judges as abetting Magnitsky’s rights violations.
“Legal proceedings were initiated against a couple of officials in the prison medical service. The report of the Russian Human Rights Council released on 6 July 2011 evokes responsibilities more widely shared in the mistreatment of Mr. Magnitsky while in detention,” said Alan Juppe. Read more

Министр иностранных дел Франции Алан Жупе призвал российские власти последовать рекомендациям Совета по правам человека при Президенте России и расширить список лиц, привлекаемых к уголовной ответственности по делу Магнитского. В письме к депутату национального собрания Франции Жаку Лангу Министр французского внешнеполитического ведомства подчеркнул, что Франция будет предпринимать все от нее зависящее для установления справедливости в этом деле и поддержания прав человека и законности в России.
«Обстоятельства гибели господина Магнитского, ведшего мужественную борьбу с коррупцией и произволом, вызывают у нас глубокую обеспокоенность…И на двустороннем уровне, и совместно с нашими европейскими партнерами, Франция будет предпринимать все усилия для развития верховенства закона в России», – сказано в письме Алана Жуппе.
«Уголовное преследование в настоящее время осуществляется в России в отношении нескольких сотрудников медицинского персонала тюремной службы. Однако в докладе Совета по правам человека, опубликованном 6 июля 2011 года, речь идет о более широком круге ответственных за нарушения прав Магнитского при содержании под стражей», – подчеркнул министр Жуппе.
