The Moscow City Bar Association has condemned the systematic persecution of Russian lawyers of the Hermitage Fund who had reported state officials involved in the theft of $230 million of budget funds and has called upon the Russian General Prosecutor Yuri Chaika to open a criminal case against those officials. Official Investigation into Sergei Magnitsky’s Death Furthers the Cover Up of the Reasons for His Detention and Death in Custody, Aims to Absolve All Government Officials from Any Responsibility
30 June 2010 – The results of the Russian government’s official investigation of medical documentation concerning Sergei Magnitsky, the 37 year-old anti‑corruption lawyer who was arrested after he had testified about police corruption and who was later tortured in custody, show an intent to ignore and cover up the systematic denial of medical care to Magnitsky during the months he was held in pre-trial detention (see Cover Up Fact Sheet below). The independent findings of the Moscow Prison Watchdog fully refute those official results and describe in detail how Magnitsky was tortured and deprived of medical care in custody (see at: http://russian-untouchables.com/eng/torture-and-death‑i/#D24).
“Instead of shedding light on how Sergei Magnitsky was arrested on trumped-up charges, tortured and died in pre-trial detention, the results of the official review of Sergei’s medical records accomplish only one goal: to cover up how he was systematically denied medical care and murdered in custody and to exonerate the senior officials involved,” said a representative of Hermitage Capital.
The results of the government investigation of Magnitsky’s death announced yesterday simply ignore the summary refusals by all Russian government bodies – detention center officials, judges, investigators and prosecutors – to provide Magnitsky with a basic doctor examination and treatment during his last four months in custody. They ignore the hundreds of complaints filed by Sergei Magnitsky about his unjust detention, pressure upon him, denial of medical care, deprivation of sleep, food and drink as a result of which after seven months in custody he lost 20 kilograms and developed acute pains, was vomiting and diagnosed with pancreatitis, cholecystitis and gallbladder disease.
The official report relied solely on documents made available to them by Magnitsky’s torturers – Interior Ministry and detention center officials – and ignored Magnitsky’s own accounts and independent findings by Moscow Prison Watchdog and human rights organizations. The authors of the official report, themselves admitting to “poor quality of medical records” and suggesting that medical examinations “could have been better” in Magnitsky’s case, nevertheless concluded that his death was caused by “acute heart failure,” the conclusion which contradicts even the medical records of the detention centers and effectively absolves anyone from responsibility for his death.
The official findings are contradicted by the conclusions of independent investigations. First, the Moscow Prison Watchdog that published its report following review of documentary evidence and visits to detention centers where Magnitsky was held concluded that Magnitsky was “subjected to torturous conditions” and that “psychological and physical pressure was exerted upon him” in custody and that he was deliberately deprived of life.
Second, in March 2010, the Moscow Helsinki Group, an independent Russian human rights organization, following their own review of Magnitsky’s case, filed a criminal complaint with Mr Bastrykhin, Head of the Russian Investigative Committee, demanding that he urgently open a criminal investigation against the Interior Ministry officers for their involvement in the murder of Sergei Magnitsky perpetrated with special brutality in order to cover up their participation in a massive fraud – the theft of US$230 million from the Russian people – the crime discovered by Sergei Magnitsky (http://russian-untouchables.com/eng/torture-and-death‑i/#D80). Cover Up of the Denial of Medical Care to Sergei Magnitsky
FACT SHEET
1) Sergei Magnitsky, a 37-year old lawyer for Hermitage Fund, was arrested a month after giving testimony about the involvement of Interior Ministry officers in the theft of US$230 million from the Russian budget (http://russian-untouchables.com/eng/testimonies/#D65). He was arrested by the Interior Ministry officers he had testified against. At the time of his arrest he was healthy.
2) During his first seven months in pre-trial detention, he was put under inhumane conditions and subjected to psychological and physical pressure, numerous and unreasonable cell-to-cell transfers (often at night), lost 20 kilograms of weight and quickly developed the following diseases: pancreatitis, gallstones and cholecystitis. All of these medical conditions were diagnosed by the medical staff of “Matrosskaya Tishina” on July 1, 2009 (http://russian-untouchables.com/eng/torture-and-death-iii/#D05).
3) Once these diseases were identified, the doctors of Matrosskaya Tishina arranged to have a second medical examination, including an ultrasound, and then an operation within one month, i.e. before August 1, 2009 (http://russian-untouchables.com/eng/torture-and-death-iii/#D05). One week prior to this date, Sergei Magnitsky was hastily transferred to Butyrka pre-trial detention, where there were no conditions for the prescribed treatment, including an ultrasound or an operation (http://russian-untouchables.com/eng/torture-and-death‑i/#D24, page 9).
4) From August to September 2009, two months before his death, Sergei Magnitsky filed over 20 complaints and appeals requesting urgent medical care for his pancreatitis and gallstones. These complaints were filed with the Russian General Prosecutor Yuri Chaika (http://russian-untouchables.com/eng/torture-and-death-ii/2/#D34, http://russian-untouchables.com/eng/torture-and-death-ii/2/#D02); Head of the Investigative Committee of the Interior Ministry, Alexei Anichin (http://russian-untouchables.com/eng/torture-and-death-ii/2/#D34); Judge Krivoruchko of the Moscow Tverskoi Court; Investigator Silchenko and Head of Butyrka pre-trail detention center, Dmitri Komnov. All of Magnitsky’s complaints were either denied or ignored (http://russian-untouchables.com/eng/torture-and-death‑v/#D19, http://russian-untouchables.com/eng/torture-and-death‑v/#D21).
5) On November 11, 2009, five days before his death, the head of Butyrka pre-trial detention Dmitri Komnov presented to court a certificate demonstrating the normal functioning of Magnitsky’s heart in order to justify his continued detention (http://russian-untouchables.com/eng/torture-and-death-iii/#D06).
6) On November 13, 2009, three days before his death, Sergei Magnitsky wrote two handwritten complaints requesting medical assistance due to his severe pain, headaches and vomiting. His conditions worsened in part due to the fact that in the middle of the night of November 12, 2009, he was once again transferred without any reason to a new cell, deprived of sleep, and for more than 24 hours deprived of food (http://russian-untouchables.com/eng/torture-and-death-iv/2/#D18). Also on November 13, he reiterated his request for an ultrasound, which had been prescribed in July 2009.
7) On November 16, 2009, Oleg Silchenko, the Investigator of the Investigative Committee of the Interior Ministry informed Sergei Magnitsky’s lawyers that Sergei was unable to leave his cell in Butyrka pre-trial detention for health reasons. At this time Silchenko refused, in violation of the law, to give Magnitsky’s lawyers a certificate of his health.
8) The preliminary death certificate Matrosskaya Tishina issued on November 16, 2009, listed the final diagnosis of Sergei Magnitsky as acute pancreatitis and acute cholecystitis (http://russian-untouchables.com/eng/torture-and-death-iii/#D07, http://russian-untouchables.com/eng/torture-and-death-iii/#D08).
9) Repeated written requests that an independent expert be assigned to the official autopsy of Sergei were denied. Sergei’s body was given to his family on the strict condition that it be used for an immediate funeral.

29 июня 2010г. – Сегодня стало известно о результатах повторной официальной медицинской экспертизы смерти 37-летнего Сергея Магнитского, которые по сообщениям прессы указывают на смерть от «острой сердечной недостаточности». Таким образом, вся ответственность пза смерть Сергея перекладывается на медицинский персонал ФСИН.
В этой связи представитель Hermitage Capital сделал следующее заявление:
«Опубликованные результаты повторной официальной экспертизы причин смерти Сергея Магнитского не вызывают никакого доверия и имеют целью скрыть совершенное в отношении Сергея преступление – незаконный арест и целенаправленное лишение его жизни в СИЗО, — а также освободить высокопоставленных чиновников и сотрудников МВД от ответственности за это преступление».
Следующие 10 фактов полностью опровергают результаты данного «исследования»:
1) Сергей Магнитский был арестован через месяц после дачи им показаний о причастности сотрудников МВД к хищению 5,4 миллиардов рублей из бюджета (http://russian-untouchables.com/rus/testimonies/#D65). Он был арестован подчиненными подполковника Кузнецова, против которого он дал свои показания. На момент ареста Сергей был здоров.
2) Через семь месяцев содержания в СИЗО, где он намеренно подвергался психологическому и физическому давлению, многочисленным переводам из камеры в камеру и из СИЗО в СИЗО, в том числе в ночное время, он потерял в весе 20 кг, и у него развились серьезные заболевания (панкреатит и холецистит), впервые диагностированные в «Матросской тишине» 1 июля 2009 года. 3) После выявления приобретенных в СИЗО заболеваний, врачи «Матросской тишины» назначили Сергею Магнитскому проийти в течение месяца, т.е. до 1 августа 2009 года, повторное медицинское обследование УЗИ и плановую операцию (http://russian-untouchables.com/rus/torture-and-death-iii/#D05), однако за неделю до этого, 25 июля, Сергей Магнитский был спешно переведен в «Бутырку», где отсутствовали условия для лечения и даже аппарат УЗИ. 6) 13 ноября 2009 года, за три дня до смерти, Сергей Магнитский написал два собственноручных заявления с требованием оказать ему медицинскую помощь в связи с тяжелым обострением болезни, болями, рвотой, вызванными в частности тем, что в середине ночи 12 ноября 2009 года он был в очередной раз переведен в новую камеру, его лишили сна, и в течение более 24 часов он был лишен пищи (http://russian-untouchables.com/rus/torture-and-death-iv/2/#D18). Он также потребовал провести, наконец, ему обследование УЗИ, назначенное еще в июле 2009 года.
7) 16 ноября 2009 года следователи СК при МВД РФ Сильченко и Олейник сообщили адвокатам Сергея Магнитского, что он не может покинуть камеру «Бутырки» по состоянию здоровья, но при этом отказались предоставить адвокатам справку о состоянии его здоровья, заявив, что это «тайна следствия».
8 ) В справках из «Бутырки» и «Матросской тишины» о диагнозе Магнитского в день его смерти – 16 ноября 2009 года – в качестве диагноза указаны «острый панкреатит» и «острый холецистит». 9) Во время похорон родственники Сергея обнаружили разбитые костяшки пальцев на левой руке Сергея, а на правой руке – синяк между большим и указательным пальцем, что говорит о применение против него перед смертью физической силы (см http://dr-timur.ru/node/263, http://russian-untouchables.com/images/hands.jpg).
10) После смерти Сергея Магнитского его родственникам было отказано во включении независимого эксперта в группу, проводившую судебно-медицинскую экспертизу. Им также было отказано в проведении независимой экспертизы. Им разрешили получить его тело только на условии немедленного захоронения.
В апреле 2010 г. Московская Хельсинкская группа обратилась к главе СКП РФ Бастрыкину с заявлением о возбуждении уголовного дела в отношении сотрудников МВД за убийство Сергея Магнитского, совершенное с особой жестокостью с целью скрыть участие этих сотрудников МВД в другом преступлении, раскрытом Сергеем Магнитским – хищении 5,4 миллиардов рублей из бюджета страны (http://russian-untouchables.com/rus/torture-and-death‑i/#D80).

U.S. State Secretary Clinton Demands That “Justice Be Delivered” in the High-Profile Murder Case of the Russian Anti-Corruption Lawyer Sergei Magnitsky

25 June 2010 – U.S. Secretary of State Hillary Rodham Clinton has demanded that “justice be delivered” in the case of 37-year old Russian anti-corruption lawyer Sergei Magnitsky, who was arrested and tortured to death in pre-trial detention by the Russian Interior Ministry officers he had accused of $230 million corruption.
Speaking in Washington yesterday at the second U.S. – Russia Civil Society to Civil Society Summit, Secretary Clinton said:
“But there is another element to our agenda. By shining a spotlight on the work of civil society groups like yours, we think we can help protect activists whose work can make them a target of abuse and violence. In particular, as I said last year, the United States remains deeply concerned about the safety of journalists and human rights activists in Russia. Among others, we remember the murdered American journalist Paul Klebnikov; the Russian lawyer Sergei Magnitsky, who died in pre-trial detention last year. We continue to urge that justice be delivered in these cases. We’re committed to working with you to find ways to reduce threats and protect the lives of activists.”

Artem Kuznetsov” highlighting in graphic detail the tragedy of Sergei Magnitsky and the “rich and famous” life-styles of state officials Sergei had exposed. The video has gone viral in Russia. In the first two days since the release, 100,000 Russians have watched the Russian version of the movie. The internet is flooded with Russian bloggers posting the video and their comments of outrage with the corrupt officials and sympathy for Sergei. According to you-tube, the “Russian Untouchables” video has been Number 1 rated in Russia, and in Russian News and Russian Politics categories. The video refers its viewers to a dedicated website “Stop the Untouchables. Justice for Sergei Magnitsky”: www.russian-untouchables.com, which contains hundreds of documents detailing the torture and murder of Magnitsky in custody, and his testimonies against corrupt officers.
Sergei Magnitsky was arrested on fabricated charges, intentionally denied medical care, subjected to cruel and inhuman treatment and torture in pre-trial detention by the Interior Ministry in an attempt to silence and punish him for his testimony against the officials he had accused of embezzling $230 million of state funds. He repeated his testimony one month prior to his death. Five days before his death, he submitted a hand-written complaint to the government and to the court seeking to bring to justice those officials who organised his persecution. In April, the Moscow Helsinki Group, an independent Russian human rights organisation, called to prosecute officials of the Russian Interior Ministry for Magnitsky’s murder.
