US Government Bans Entry To Russian Officials involved in the Magnitsky Case

Today it was con­firmed that US Sec­re­tary of State, Hillary Clin­ton, has imposed visa sanc­tions on Russ­ian gov­ern­ment offi­cials asso­ci­at­ed with the death in police cus­tody of 37-year old anti-cor­rup­tion lawyer Sergei Mag­nit­sky. Amer­i­ca is the first coun­try to offi­cial­ly impose sanc­tions on the Russ­ian offi­cials involved in the Mag­nit­sky case.

“The facts are so shock­ing about the false arrest, tor­ture and death of Sergei Mag­nit­sky that coun­tries are now start­ing the act to pro­hib­it the peo­ple who killed Sergei from com­ing into their ter­ri­to­ries. The first domi­no has fall­en and many more will fol­low soon,” said a Her­mitage Cap­i­tal representative.

This news comes from com­ments by the Oba­ma admin­is­tra­tion on the forth­com­ing Mag­nit­sky leg­is­la­tion, known as the “Sergei Mag­nit­sky Rule of Law Account­abil­i­ty Act of 2011”. This leg­is­la­tion is spon­sored by 19 lead­ing sen­a­tors from both the Demo­c­ra­t­ic and Repub­li­can par­ties. The leg­is­la­tion calls for visa sanc­tions and asset freezes on indi­vid­u­als involved in Magnitsky’s false arrest, tor­ture and death, as well as on per­pe­tra­tors of oth­er gross human rights vio­la­tions. Sergei Magnitsky’s Mother Goes to Court Against Russian Investigators for Withholding Evidence on the Death of Her Son

Today at noon the Bas­man­ny dis­trict court in Moscow (11 Kalanchevskaya street) will hear a law­suit filed by Sergei Magnitsky’s moth­er demand­ing that the Russ­ian Inves­tiga­tive Com­mit­tee release tis­sue sam­ples of her dead son, a 37-year old Russ­ian anti-cor­rup­tion lawyer who was tor­tured to death in police custody.

Mrs. Natalia Mag­nit­skaya filed a law­suit after the Russ­ian Inves­tiga­tive Com­mit­tee refused to give her access to the archive of tis­sues and organs which have been in state cus­tody since Sergei Magnitsky’s death on Novem­ber 16, 2009. The Mag­nit­sky fam­i­ly is seek­ing an inde­pen­dent med­ical eval­u­a­tion because the Russ­ian author­i­ties have giv­en con­tra­dic­to­ry accounts of Magnitsky’s death, includ­ing the time, place and the rea­son of his death, and have con­cealed the evi­dence of the role offi­cials had played in his tor­ture in cus­tody. After Magnitsky’s death, Russ­ian author­i­ties have refused fam­i­ly requests for an inde­pen­dent autop­sy, as well as review by inde­pen­dent experts. Сегодня Басманный суд Москвы рассмотрит жалобу на следователей, скрывающих архив органов Сергея Магнитского от его матери

Сегодня в 12 ч дня Бассманный суд Москвы рассмотрит жалобу на следователей Следственного комитета РФ, скрывающих от матери Сергея Магнитского архив его органов.

«Мама Сергея Магнитского заявила ходатайство о доступе к его гистологическому архиву с целью установления истины, ускорения получения объективных результатов, а не тех, которые в настоящее время находятся в материалах уголовного дела, но ей в этом было отказано. Матери было отказано получить частичку ее сына для того, чтобы понять, кто и при каких обстоятельствах его убил. Такая позиция следствия является не только не конституционной, но также бесчеловечной и аморальной», — сказал адвокат Николай Горохов, представляющий интересы Натальи Николаевны Магнитской в суде.

Образцы тканей Сергея Магнитского были изъяты после его смерти во время официального вскрытия и находятся в распоряжении Следственного комитета РФ. В июне этого года мама Сергея Магнитского обратилась к следователям с просьбой предоставить ей архив органов ее сына для проведения независимого медицинского исследования. В этой просьбе Следственный комитет отказал, заявив, что у потерпевших родственников нет права проводить собственные исследования. В жалобе, поданной в Басманный суд адвокатом Натальи Магнитской Николаем Гороховым, говорится, что эта позиция следствия не соответствует положениям Конституции и уголовно-процессуального закона, которые дают право потерпевшим собирать и представлять доказательства. Physi­cians for Human Rights (PHR), an inde­pen­dent orga­ni­za­tion that uses the integri­ty of med­i­cine and sci­ence to stop mass atroc­i­ties and severe human rights vio­la­tions against indi­vid­u­als, today announced that cal­cu­lat­ed, delib­er­ate and inhu­mane neglect ulti­mate­ly led to the death of 37-year-old anti-cor­rup­tion lawyer Sergei Mag­nit­sky. Mag­nit­sky died fol­low­ing 358 days in police cus­tody in Moscow in Novem­ber 2009. The high pro­file case has focused inter­na­tion­al atten­tion on human rights abuse and cor­rup­tion in Russia.

PHR’s experts, includ­ing a lead­ing foren­sic pathol­o­gist and a car­di­ol­o­gist and prison health expert, reviewed avail­able doc­u­men­ta­tion in the case at the request of the Mag­nit­sky fam­i­ly. In the first inde­pen­dent med­ical eval­u­a­tion of the Mag­nit­sky case, the experts expressed con­cern about the pos­si­bil­i­ty of incom­plete evi­dence col­lec­tion and appar­ent con­tra­dic­tions in the Russ­ian death inves­ti­ga­tions and PHR’s find­ings.
