Советник Президента США по национальной безопасности Майкл Макфол встретился в Москве с матерью Сергея Магнитского, погибшего в СИЗО от пыточных условий созданных ему сотрудниками МВД, уличенными им ранее в коррупции и хищении государственных денег
28 мая 2010 года – Вчера Майкл Макфол, советник Президента США по национальной безопасности, встретился в Москве с Натальей Николаевной Магнитской, матерью 37-летнего Сергея Магнитского, погибшего в московском СИЗО шесть месяцев назад. Майкл Макфол передал личные соболезнования от президента США Барака Обамы.
В ходе заседания Российско-Американской рабочей группы по развитию гражданского общества под председательством первого заместителя руководителя администрации Президента РФ Владиславом Сурковым Майкл Макфол поднял вопрос о Сергее Магнитском как свидетельство «страшных и трагических событий», произошедших в России. Заседание, прошедшее 27 мая в г. Владимире, было посвящено вопросам соблюдения прав человека, реформы пенитенциарной системы и миграции.
Днем ранее, 26 мая 2010 г., советник по национальной безопасности США Макфол также обсудил дело Сергея Магнитского на встрече с Валерием Борщевым, председателем Общественной наблюдательной комиссии по соблюдению прав человека в местах содержания под стражей г. Москвы (ОНК). Ранее Комиссия, возглавляемая Борщевым, подготовила и опубликовала доклад об обстоятельствах смерти Сергея Магнитского, в котором было указано, что Сергей Магнитский систематически подвергался физическому и психологическому давлению со стороны сотрудников МВД, создавших ему пыточные условия содержания, лишая доступа к медицинской помощи с целью заставить его дать ложные показания. В отчете Комиссии также отмечалось, что руководители, служебный и медицинский персонал СИЗО «Бутырка» и «Матросская тишина», в которых содержали Сергея Магнитского, предоставили членам Комиссии противоречивые сведения, о том, что происходило с Сергеем в последние часы его жизни – это заставило членов Комиссии усомниться в их показаниях, и сделать вывод о том, что правда произошедшего с Сергеем намеренно скрывается от них.
Сергей Магнитский, представлявший, в том числе интересы фонда Hermitage, был арестован и удерживался в следственном изоляторе в течение 12 месяцев сотрудниками МВД, против которых он ранее дал обличающие свидетельские показания об их причастности к краже компаний фонда и последующему хищению 5,4 миллиардов бюджетных средств. Спустя месяц после того как Магнитский повторил свои показания против этих сотрудников внутренних дел, обвиняя их: в организации расправы над ним; незаконном аресте по заранее сфабрикованному делу; изоляции его от семьи и общества; жестоком и унижающем человеческое достоинство обращении; лишении права на медицинскую помощь – Магнитский был найден мертвым в камере СИЗО. Семье Магнитского было отказано в проведении независимой судебно-медицинской экспертизы. Согласно докладу ОНК, в последние часы своей жизни Сергей Магнитский заявил, что его пытаются убить. На похоронах родственники Сергея Магнитского обнаружили синяки и ссадины на его теле.
Сергей Магнитский был единственным сыном Наталии Николаевны Магнитской. Сергей оставил жену и двоих детей.

U.S. National Security Adviser McFaul Meets Natalia Magnitskaya, Mother of Anti-Corruption Lawyer Sergei Magnitsky Unlawfully Detained and Killed in Russian Custody
28 May 2010 – Yesterday, Michael McFaul, Special Assistant to U.S. President Obama and Senior Director of Russian and Eurasian Affairs at the U.S. National Security Council, met in Moscow with Natalia Magnitskaya, mother of the late anti-corruption lawyer, Sergei Magnitsky, who was killed in a Moscow pre-trial detention center six months ago.
McFaul emphasized the case of Sergei Magnitsky among “atrocious, tragic things” during a discussion of human rights, prison reform and migration issues at a meeting yesterday of the US-Russia Civil Society Working Group, which he co-chairs with First Deputy Head of the Russian Presidential Administration, Vladislav Surkov. The meeting took place yesterday in Vladimir, Russia.
McFaul also discussed the case of Sergei Magnitsky at a meeting with Valery Borschev, chair of Moscow Prison Oversight Commission (MPOC), on May 26. The MPOC issued a damning report earlier this year into the death of Sergei Magnitsky stating that during Magnitsky’s pre-trial detention he was subjected to physical and psychological pressure, torturous conditions and deprived of medical care by Interior Ministry investigators in order to obtain false testimonies from him. The report also indicated that prison officials and doctors gave entirely contradictory accounts of what happened to Magnitsky in custody in the last hours of his life. The MPOC concluded that those officials were deliberately concealing the truth.
Sergei Magnitsky, a lawyer for the Hermitage Fund, was arrested and held for 12 months in torturous conditions without trial by the Interior Ministry officers against whom he had testified for their involvement in the abuse of office and the theft of $230 million budget funds. One month after Magnitsky repeated his testimony against those officers and accused his captors from the Russian Interior Ministry of organising his unlawful arrest on false grounds, keeping him hostage in isolation from family and society, organising cruel and degrading treatment and depriving him of medical care, he was found dead in an isolation cell. His family was denied an independent autopsy. According to the MPOC, in the last hours of his life, Magnitsky stated that someone was trying to murder him. Bruises were seen on his body at the funeral.
Sergei Magnitsky was the only son of Ms Magnitskaya. He left a wife and two children.

European Home Affairs Commissioner Calls for the Investigation of Russian Interior Ministry Officers for Corruption and the Murder of Sergei Magnitsky

Today at a meeting with Russian Interior Minister Rashid Nurgaliev and Russian Justice Minister Alexander Konovalov, the European Home Affairs Commissioner Cecilia Malmström raised alarm and indignation over the continued impunity of Russian Interior Ministry officers implicated by Russian lawyer Sergei Magnitsky in the theft of $230 million from the Russian government and in these same officers’ involvement in Magnitsky’s subsequent murder in custody six months ago. The discussion formed part of the 12th meeting of the EU-Russia Permanent Partnership Council on Freedom, Security and Justice held in Kazan, Russia.
“The persecution of Sergei Magnitsky by the officials he had testified against is an emblematic case of the misuse of office and corruption in the police force from which both European and Russian businesses suffer and the lives of ordinary people are ruined. Bringing it up at the EU-Russia Council demonstrates how important it is at the highest political level of the EU. We will continue to do everything to ensure that there is justice for Magnitsky and the cause he fought for,]” said [spokesperson for] Commissioner Malmström.
At the meeting with Russian Ministers Nurgaliev and Konovalov, the EU delegation raised serious concerns about the absence of any investigation into the Interior Ministry Officers’ corruption. In particular, they asked why Yuri Draguntsov, Head of the Russian Interior Ministry Internal Security Department, had refused to investigate complaints about the involvement of Interior Ministry officers, Lt Col Artem Kuznetsov and Major Pavel Karpov – who had been named by Sergei Magnitsky – for the abuse of office and the theft of $230 million of state funds, and why that same Lt Col Kuznetsov was later allowed to “investigate himself” in the theft of $230 million in which he was implicated.
The EU delegation also raised questions over how the arrest and detention of Magnitsky was allowed to be carried out by Russian Interior Ministry officers who had a conflict of interest, and despite multiple complaints. In particular, they asked why, one month after Sergei Magnitsky testified against Lt Col Kuznetsov for corruption, that same Lt Col Kuznetsov and his subordinates were appointed by Oleg Logunov (then Deputy Head of the Russian Interior Ministry Investigative Committee) to initiate charges against Magnitsky, and why the approval for Magnitsky’s arrest and 12-month detention relied mainly on statements from the same Lt Col Kuznetsov’s subordinates (A.O. Droganov, A.A. Krechetov and D. Tolchinsky), despite Lt Col Kuznetsov’s clear conflict of interest.
Furthermore, the EU delegates shared with their Russian counterparts a list of questions about the deprivation of medical care and the concealment of Sergei Magnitsky’s state of health from his lawyers in the final hours of his life. Particular emphasis was placed on the role of Oleg Silchenko, the chief Interior Ministry investigator on Magnitsky’s case, who refused Magnitsky’s requests for an ultrasound examination filed in August 2009. On the last day of Magnitsky’s life, investigator Silchenko refused lawyers access to Magnitsky and to any information about his state of health, claiming it was an “internal matter of the investigation,” his condition was “not serious” and he was “unable to leave his cell” at the same time when Magnitsky, according to detention center officials, was being transported from Butyrka to a health unit at Matrosskaya Tishina detention centre.
In April 2010, the Moscow Helsinki Group, an independent human rights organisation, demanded the opening of a criminal case into the murder of Sergei Magnitsky, accusing Interior Ministry officials (Investigator Silchenko, Lt. Col. Kuznetsov and his subordinates A. O. Droganov, A. A. Krechetov and D. Tolchinsky, among others) of complicity in the crimes under several articles of the Russian Criminal Code (“Murder committed to conceal another crime – theft of state budget funds”; “Murder committed with extra brutality”; “Torture”; “Forcing Testimony”; “Abuse of office”). Despite the high-profile nature of the case, no investigation whatsoever has been initiated nor have any prosecutions been brought against these Interior Ministry officers.
Magnitsky courageously testified about the theft of his client’s companies and $230 million of state budget funds by corrupt Russian officials, including Lt. Col. Kuznetsov and Major Karpov, in October 2008. Immediately afterwards, he was arrested on false charges by those same officials, refused bail and tortured over the next 12 months to withdraw his testimony. Magnitsky refused and instead on 13 October 2009, he repeated his testimony about the involvement of Interior Ministry officers in the theft of state budget funds in which he also accused Interior Ministry officers of organizing his unlawful arrest and the fabrication of a case against him in retribution for his testimony about the $230 million corruption. One month later, on 16 November 2009, Magnitsky was found dead in a Moscow pre-trial detention center. In his final hours, Magnitsky stated that people were trying to murder him. At the funeral, bruises were clearly seen on his body. Magnitsky’s family was denied their request for an independent autopsy.
The 12th meeting of the EU-Russia Permanent Partnership Council on Freedom, Security and Justice took place today in Kazan. Russian Interior Minister Nurgaliev and Justice Minister Konovalov headed the Russian delegation. Commissioner Malmström represented the EU delegation.
The EU-Russia relationship is formally conducted within the Partnership and Cooperation Agreement. One of the four Common Spaces is the Common Space of Freedom, Security and Justice as a cornerstone for developing future cooperation in this area.

Cегодня в ходе заседания Постоянного совета по партнерству ЕС и России в сфере обеспечения свобод, безопасности и реализации правосудия комиссар ЕС по внутренним делам Сесилия Мальмстрем задала вопросы российскому министру внутренних дел Рашиду Нургалиеву и министру юстиции РФ Александру Коновалову о роли сотрудников МВД РФ в коррупционной схеме хищения 5,4 миллиардов рублей государственных средств и гибели полгода назад в СИЗО юриста Сергея Магнитского, разоблачившего это преступление. Магнитский был арестован в своей московской квартире 24 ноября 2008 года вскоре после дачи им показаний о причастности сотрудников МВД к коррупции. После 11 месяцев в СИЗО и за месяц до гибели, 13 октября 2009 года, он вновь подтвердил свои показания об участии сотрудников МВД в хищении бюджетных средств, а также в организации его незаконного ареста и травли в качестве расправы за данные им показания. За пять дней до гибели Магнитский подал жалобу о фальсификации против него уголовного дела в суд. 16 ноября 2009 года он был найден мертвым в камере московского СИЗО.
На встрече с российскими министрами Нургалиевым и Коноваловым, прошедшей в Казани, делегация ЕС выразила обеспокоенность отсутствием должного расследования в отношении чиновников МВД, причастных к коррупции. В частности, их интересовало, почему глава Департамента собственной безопасности МВД РФ Юрий Драгунцов отказался расследовать заявления о должностных преступлениях, совершенных подполковником Кузнецовым и майором Карповым, и их причастности к хищению 5,4 миллиардов рублей бюджетных средств, и каким образом подполковник Кузнецов был затем допущен к расследованию жалоб на самого себя.
