Last Words by Sergey Magnitskiy in Russian Court Reveal Human and Legal Rights Abuse

20 November 2009 – The last words by lawyer Sergey Magnitskiy, made in a Russian court, reveal violations of his legal and human rights in breach of the European Convention for the Protection of Human Rights and Fundamental Freedoms and Russian law.

In his last public statement, Sergey Magnitskiy named the violations of Article 3 of the Convention – “Prohibition of torture” – that states that “no one shall be subjected to torture or to inhuman or degrading treatment or punishment,” and of Article 6 – “Right to a fair trial” – that specifies the right for “adequate time and facilities for the preparation of his defence”. He accused the court of condoning these violations and refusing him his basic human dignity.

On Monday, 16 November 2009, Sergei Magnitskiy, 37, who bravely exposed massive corruption by Russian Interior Ministry officials, tragically passed away at a Moscow prison where he was kept for a year without trial. He left a wife and two children.

В понедельник, 16 ноября 2009 года, в следственном изоляторе «Матросская тишина», в Москве, трагически скончался Сергей Магницкий, 37-ми летний адвокат, отдавший свои силы, здоровье и жизнь борьбе по разоблачению масштабной коррупции в рядах МВД России. За несгибаемую волю, принципиальность, человеческую порядочность следователи держали Сергея в тюрьме в течение года. У него остались жена и двое детей.

Prosecutor Office Denies an Independent Medical Examination into the Cause of Death of Sergey Magnitskiy

19 November 2009  –  The lawyers of Sergey Magnitskiy have been informed that the Moscow Prosecutor Office rejected a request for an independent medical examination into his death.

Sergey Magnitskiy died on 16 November 2009 in a Moscow prison, where he was kept without trial for 12 months. His mother requested an independent medical examination into the cause of death of her 37-year old son. The appeal was made by lawyers to the Preobrazhensky district of the Moscow Prosecutor Office.
