Prosecutor Chaika’s Role in Magnitsky Case Explains His Unhinged Attack on Bill Browder in Response to Corruption Expose Produced by Navalny

18 December 2015 – Russian General Prosecutor Yuri Chaika played a significant  role in the ill-treatment and death in custody of Sergei Magnitsky and the subsequent cover up in his case. Chaika’s recent emotional attack on Bill Browder, the head of Magnitsky Justice Campaign, can be explained by his complicity in the Magnitsky case and the pressure it has put on him internationally.

 

It is no coincidence that in response to allegations of brazen abuse by his sons and senior prosecutors made in Alexei Navalny’s video earlier this month, General Prosecutor Chaika decided to unleash his frustration on Magnitsky justice campaigners. This is because of Chaika’s personal role in the Magnitsky case and its subsequent cover up,” said Bill Browder, head of the Magnitsky Justice Campaign, and author of ‘Red Notice’.

 

The chronology of Chaika’s role in the Magnitsky case is summarized below:

 

1) On December 3rd 2007, the Hermitage Fund wrote a criminal complaint to Prosecutor Chaikabased on Sergei Magnitsky’s investigation about the theft of Hermitage Fund’s companies and the creation of $1 billion of fake liabilities which were executed with documents seized by the police. This was three weeks before $230 million were stolen from the Russian budget. Chaika assigned the crime report to his deputy Victor Grin, who took no action. Had Chaika and Grin acted, they would have prevented the theft of $230 million from the Russian people.

 

2) On July 23rd 2008, the Hermitage Fund filed a second criminal complaintto Prosecutor Chaika prepared based on Sergei Magnitsky’s investigation describing the discovery that the theft of the Hermitage Fund’s companies was perpetrated in order to steal $230 million of taxes paid by Hermitage Fund’s companies to the Russian Government. Prosecutor Chaika became personally involved in overseeing the investigation, with his senior aid prosecutor Bumazhkin responding on 18 August 2008 that the investigation was under the control of the General Prosecutor’s Office and had exonerated the low-level perpetrators for the lack of crime in their actions. Chaika’s office later also exonerated all tax officials who approved the largest tax refund in Russian history in one day saying they were ‘tricked and deceived.’

 

3) On November 24th 2008, Hermitage’s lawyer Sergei Magnitsky was arrested by the same police officials who were implicated in his testimony and the crime report Hermitage submitted to Chaika that summer. He was subsequently tortured in prison to get him to retract his testimony.

 

4) On June 8th 2009, the International Bar Association wrote to Prosecutor Chaika seeking his intervention in the case of unlawful arrest of Sergei Magnitsky. A similar letter of intervention was addressed to Chaika on 24 July 2009 by the English Law Society. In September 2009, Chaika’s office responded that there were “no violations in Sergei Magnitsky’s case and no reasons to intervene.”

 

5) On August 17th 2009, Sergei Magnitsky filed a complaint against Prosecutor Chaikaand held him personally responsible for the violation of his human rights in detention by Chaika’s subordinates (prosecutors Burov and Pechegin) who by law were mandated to intervene.

 

6) On September 11th 2009, Sergei Magnitsky’s lawyers wrote to Prosecutor Chaika about the pressure being applied to Sergei Magnitsky to force him to give false testimony and the withholding of medical care. Chaika’s office replied in October 2009 stating that ‘no physical or psychological pressure was exerted on defendant  S.L.Magnitsky…There are no grounds to take measures of prosecutorial response.”

 

7) On November 16th 2009, after suffering from months of torture and neglect, Sergei Magnitsky died after a beating with rubber batons by guards.

 

8) In July 2010, Prosecutor Chaika commented on Magnitsky case not finding any responsibility of the General Prosecutor’s office, only of prison personnel.

 

9) In May 2011, Chaika’s senior subordinate issued conclusions exonerating Interior Ministry officers from responsibility for the false arrest and torture in detention of Sergei Magnitsky.

 

10) On 31 May 2011, President Medvedev ordered Chaikato exercise personal control over the Magnitsky death investigation and the investigation into the $230 million fraud.

 

11) On 1 June 2011, Prosecutor Chaika announced that he would bring creme de la creme of prosecutors to oversee the Magnitsky case. The official General Prosecutor’s Office statement said: “Due to the public resonance on instruction from the President of Russia, the General Prosecutor’s Office has created a group of prosecutors comprising employees of different specialised departments in order to strengthen and ensure qualified oversight over the process and results of the investigation of criminal cases by the Investigative Committee of Russia and the Investigative Department of the Interior Ministry of Russia.”

 

12) On January 23d 2012, Prosecutor Chaika personally blocked the proposal from the President’s Human Rights Council to combine the investigations of Sergei Magnitsky’s death and the $230 million fraud he had uncovered, having concealed in his report to the President that the conclusions drawn by his senior subordinates had exonerated Interior Ministry officials in the Magnitsky case.

 

13) In March 2013, the investigation into Magnitsky’s death was closed, finding no crime occurred, the conclusion that was approved by Chaika’s subordinate prosecutor Bochkaryev.

 

14) In 2013, Chaika’s Prosecutor’s Office advanced the posthumous trial over Sergei Magnitsky, the first in Russian legal history, with posthumous indictment of Sergei Magnisky sanctioned by Chaika’s deputy Victor Grin.

 

Prosecutor Chaika was one of the key Russian officials responsible for the human rights violations of Sergei Magnitsky when he was still alive and the cover-up of official responsibility of Sergei Magnitsky’s murder after he died. 18 декабря 2015 года – Рупор Кремля телеканал НТВ анонсировал фильм в поддержку Юрия Чайки. Ранее Генеральный прокурор России Юрий Чайка сделал публичное заявление о том, что фильм Алексея Навального о криминальном бизнесе его сыновей и ближайших сотрудников якобы “заказал” руководитель международной кампании “Справедливость для Магнитского” Уильям Браудер. Панические откровения Юрия Чайки не случайны и связаны с его ролью в деле Магнитского.

 

В том, что говорит Чайка и, тем более, в том, что озвучивают беспринципные пропагандисты государственных телеканалов, нет правды. При помощи грубой дезинформации они хотят решить сразу две актуальных для них проблемы: отвлечь внимание общественности от сути обвинений, озвученных Навальным в Москве, и приостановить поиск украденных у россиян 5,4 миллиардов рублей – преступления, раскрытого Сергеем Магнитским – по всему миру. Нет случайности в том,– сказал представитель программы “Справедливость для Магнитского”, что главным прокурором России овладела мысль, будто инициатива создать фильм “Чайка”  о злоупотреблениях в прокуратуре принадлежит Уильяму Браудеру. Хронология событий, указывающая на роль Генерального прокурора Чайки в деле Магнитского:

 

1) 3 декабря 2007 года на имя прокурора Чайки фонд Hermitageподал заявление о возбуждении уголовного дела в отношении уголовников, на которых при содействии сотрудников МВД РФ были мошенническим образом перерегистрированы три российские компании фонда и организованы подложные иски на 1 миллиард рублей. На следующий день, 4 декабря 2007 года, жалоба поступила заместителю Генерального прокурора Виктору Гриню, который не предпринял никаких действий , что позволило преступникам спустя две недели открыть счета от имени похищенных компаний в банках “Интеркоммерц” и “Универсальный банк сбережений”, а к концу месяца, 24 декабря 2007, подать подложные заявления о возврате якобы “излишне уплаченного” налога на прибыль в размере 5,4 миллиардов рублей, и незамедлительно получить одобрение руководства налоговых инспекций №25 и №28 г. Москвы на возврат средств. Спустя два дня  казначейство зачислило мошенникам деньги граждан России.

 

2)   23 июля 2008 года на имя прокурора Чайки поступило новое заявление фонда Hermitage о возбуждении уголовного дела в отношении той же преступной группы в связи с обнаружением деталей хищения 5,4 миллиардов рублей из российского бюджета. Хищение денежных средств было организовано при прямом содействии руководителей московских налоговых инспекций №25 и №28, одобривших возврат средств и “утративших” при пересылке финансовые и регистрационные документы, по которым они одобряли заявления мошенников о возврате 5,4 миллиардов рублей. На заявление фонда 18 августа 2008 года ответил старший помощник прокурора Чайки А. Бумажкин, сообщив, что преступники Маркелов, Курочкин и Хлебников освобождены от уголовной ответственности в связи с “отсутствием состава преступления”, а также, что “результаты расследования контролируются в Генеральной прокуратуре”, позволив преступникам продолжать уничтожать доказательства преступления и перевести украденные деньги за рубеж.

 

3) 24 ноября 2008 года Сергей Магнитский был арестован сотрудниками МВД, изобличёнными им в соучастии в хищении компаний фонда и 5,4 миллиардов рублей, уплаченных ими в виде налогов. Прокурор Генеральной прокуратуры Буров поддержал ходатайство о заключении Магнитского под стражу, основанное на подложных рапортах сотрудников МВД.

 

4)   В апреле 2009 года Совет Европы обратился к Генеральному прокурору РФ с запросом о незаконности ареста Сергея Магнитского подполковником Кузнецовым и его подчиненными, на который Генеральной прокуратурой был дан ответ, что такой сотрудник якобы не работает в МВД РФ (см официальный доклад представителя Парламентской Ассамблеи Совета Европы от 8 августа 2009 года).

 

5)   8 июня 2009 года Международная юридическая ассоциация обратилась к прокурору Чайке с просьбой рассмотреть вопрос о незаконном аресте Сергея Магнитского. 24 июля 2009 года аналогичный запрос был адресован прокурору Чайке обществом юристов Англии. В сентябре 2009 года подчиненный Чайки прокурор Печегин ответил, что в деле Сергея Магнитского не обнаружено нарушений и отсутствует необходимость прокурорского реагирования.

 

6)  17 августа 2009 года Сергей Магнитский подал жалобу на Генерального прокурора Чайку, указав, что считает его лично ответственным за нарушение своих прав подчиненными Чайки прокурорами Буровым и Печегиным: «10 июня 2009 года я обратился к Генеральному прокурору РФ с жалобой на действия заместителя начальника управления Генеральной прокуратуры РФ по надзору за расследованием особо важных дел Печегина А.И….В соответствии с ч.1 ст. 124 УПК РФ прокурор рассматривает жалобу в течение 3 суток со дня ее получения…Несмотря на указанные выше положения закона информацию о результатах рассмотрения моей жалобы от 10 июня 2009 года и о принятом по ней решении от Генерального прокурора РФ до настоящего времени я не получил. Указанное бездействие Генерального прокурора РФ считаю незаконным, нарушающим мои конституционные права, предусмотренные ст.33,45,52 Конституции РФ, в связи с чем я его обжалую и прошу суд признать бездействие Генерального прокурора РФ, выразившееся в нерассмотрении моей жалобы от 10 июня 2009 года и неуведомлении меня о решении, принятом по жалобе, в установленные законом сроки, незаконным.»

 

7)  11 сентября 2009 года адвокаты Сергея Магнитского обратились к Генеральному прокурору Чайке с жалобой на нарушения прав Магнитского в следственном изоляторе, отказе в медицинской помощи и оказание на него давления с целью получить ложные показания. В своем ответе прокурор Печегин сообщил, что никакого давления на Магнитского не установлено, в связи с чем нет необходимости прокурорского реагирования.

 

8)  Несмотря на пытки, организованные сотрудниками МВД, Сергей Магнитский, 14 октября 2009 года, вновь повторил данные им до ареста показания, указав, что его уголовное преследование является репрессивной мерой за помощь, которую он оказывал клиенту в расследовании обстоятельств кражи трех компаний фонда и уплаченных ими 5,4 миллиардов рублей налогов. Месяц спустя, 16 ноября 2009 года, Сергей Магнитский был убит в следственном изоляторе “Матросская тишина”.

 

9)  8 июля 2010 года в интервью “Российской газете”прокурор Чайка не признал вины своего ведомства в гибели Магнитского, указав лишь на неоказание ему медицинской помощи сотрудниками ФСИН, игнорируя организованный его ведомством саботаж в отношении жалоб на нарушение прав Магнитского, несмотря на прямую обязанность проверок соблюдения прав человека людей, находящихся в следственных изоляторах.

 

10)  В мае 2011 года Генеральная прокуратура РФ утвердила заключение об отсутствии правонарушенийв действиях сотрудников МВД РФ, преследовавших Сергея Магнитского.

 

11) 31 мая 2011 года президент Медведев поручил прокурору Чайке взять под личный контроль расследования всех дел, связанных с Сергеем Магнитским. На следующий день прокурор Чайка объявил о создании специальной группы прокуроров, в которую он привлек “весь цвет прокуратуры” по делу Магнитского.

 

12) 23 января 2012 года Генеральный прокурор Чайка направил письмо Президенту Медведеву, которым блокировал предложения Совета при Президенте по правам человека о проведении всестороннего расследования всех обстоятельств ареста и гибели Сергея Магнитского и выявленного им хищения из бюджета 5,4 миллиардов рублей, указав, что не видит необходимости в объединении дел, ссылаясь на то, что прокуратура уже направила свои выводы в Следственный комитет, при этом скрыв, что эти выводы освободили сотрудников МВД от какой-либо ответственности за преступление против Магнитского .

 

13) Ноябрь 2012 года – заместителем Чайки (прокурором Гринем) утверждено впервые в истории страны посмертное обвинительное заключение и направлено в суд для проведения посмертного процесса над Сергеем Магнитским.

 

14) Март 2013 года –  с одобрения Генеральной прокуратуры (подчиненного Чайки прокурора Бочкарева) дело о смерти Сергея Магнитского в следственном изоляторе прекращено за отсутствием события преступления.

 

Прокурор Чайка несет личную ответственность за все, что произошло с Сергеем Магнитским. Напуганный шокирующей правдой фильма Навального и своей ролью в преступлении против своих граждан и Сергея Магнитского он предпринимает смехотворные попытки уйти от правосудия“, – сказал представитель программы “Справедливость для Сергея Магнитского”.

14 декабря 2015 года – Сегодня утром газета “Коммерсант” опубликовала длинное письмо прокурора Чайки о 43-минутном фильме о коррупции и уголовщине в прокуратуре, подготовленном Фондом борьбы с коррупцией Алексея Навального. Фильм, выпущенный 1 декабря 2015 года, посмотрели 3,358,619 человек.

 

“Я впечатлен расследованием и фильмом, сделанным на его основе, и восхищен смелостью Алексея Навального и его коллег, представивших шокирующие обвинения в отношении Чайки и его семьи, но я не имею отношения к расследованию, финансированию и производству этого фильма”, – сказал Уильям Браудер, автор книги “Красный циркуляр” о современной России.

 

“Семистраничный параноидальный рассказ Чайки о том, что я агент ЦРУ, осуществлявший спецоперацию по разрушению России, выглядит как невразумительный ответ человека, попавшегося с поличным и тщетно пытающегося найти путь к отступлению,” – добавил Уильям Браудер.

 

В семистраничном ответе прокурора Чайки нет объяснения высказанным в фильме подозрениям в том, что бизнес двух его сыновей создан на рэкете и манипуляции тендерами с использованием всей структуры отделений прокуратуры по России, строится на угрозах прокурорских проверок, возбуждения уголовных дел и заключения конкурентов под стражу. В нем нет ответа по обстоятельствам убийства руководителя судостроительной компании, который противился приобретению этой компании сыном прокурора Чайки. В возбуждении уголовного дела по факту смерти этого человека было отказано. Чайка не объяснил резидентство своего сына в Швейцарии, зарубежные активы своих сыновей и жен заместителей генерального прокурора, вложенные в швейцарскую виллу и пятизвездочную гостиницу в Греции.

 

Посмотревшему этот фильм становится ясно, что прокурору Чайке надо отвечать на  серьезные обвинения. Не убедительно выглядят его попытки уйти от этих ответов переводом стрелок на иностранца, считающегося врагом президента“, – сказал Уильям Браудер.

 

“Даже если только часть выдвинутых в фильме подозрений верна, то они подтверждают, что Россия управляется как мафиозное государство мафиозными чиновниками,” – сказал Уильям Браудер.

14 December 2015 – This morning, Russian newspaper Kommersant published a highly emotional statementby Russian General Prosecutor Yuri Chaika in response to a 43-minute video expose of corruption and criminality involving his two sons and relatives of senior prosecutors in his office.

 

The “Chaika” movie was  produced by Russian anti-corruption activist Alexei Navalny and his Foundation for Fight against Corruption. It has been viewed 3,358,619 times on Youtube since its release on 1 December 2015.

 

I’m very impressed with the investigation which went into making this movie and applaud Alexei Navalny and his colleagues for their bravery in exposing the shocking allegations against Chaika and his family, but I had nothing to do with the investigation, financing or production of this film,” said Bill Browder, author and Head of the Magnitsky Justice Campaign.

 

Chaika’s 7 pages of unhinged allegations that I am a CIA agent who was running a special operation designed to destroy Russia looks like the emotional ranting of someone who has been caught red-handed and is desperately looking for an escape route,” continued Mr. Browder.

 

Most significantly, Chaika’s 7-page letter offers no explanation on the vast business empires of his two sons that were allegedly built on abuse of office of the network of prosecutors’ offices Russia-wide, raids on businesses with threats of jail-time and criminal prosecutions, rigging tenders and scaring competitors with prosecutorial probes. It also ignores the allegations that one of his sons took over a state shipping company after a manager who tried to prevent the takeover was killed. The investigation into that man’s death was closed finding no crime occurred. Prosecutor Chaika also made no comment about the international real estate holdings and assets, including a five-star Greek hotel, a Swiss villa and Swiss bank accounts, belonging to his sons and relatives of his senior colleagues in the Prosecutor’s office.

 

After watching this movie, it’s clear that Prosecutor Chaika has serious and grave allegations to answer to. It’s simply not credible for him to say that he can ignore them because a foreigner who is regarded as Putin’s number one enemy was supposedly behind them,” said Bill Browder, author of “Red Notice: How I Became Putin’s Number One Enemy.”

 

“Even if only a fraction of allegations in this movie are true, this would further confirm that Russia is truly being run like a mafia state by mafia-like officials,” said Bill Browder.

US Department of Justice Uncovers 60 New Wire Transfers through the US Banking System Connected to Magnitsky Case

 

14 December 2015 – New court documents show that the US Department of Justice has traced 60 new wire transfers through the US banking system connected to the $230 million tax rebate fraud that Sergei Magnitsky exposed in Russia. The news comes from a civil money laundering case in New York involving Prevezon Holdings, owned by a son of former vice premier of Moscow Regional government and current vice president of Russian Railways Pyotr Katsyv.

 

The US Government alleges that Prevezon engaged in laundering the proceeds from the $230 million fraud in Russia, uncovered by Sergei Magnitsky, and international transportation of stolen property.

 

The news of 60 new US bank wire transfers connected to the crime Magnitsky uncovered is a major new development in the case. Previously, the US Government disclosed only four transactions it traced, through several intermediary shell companies, to Prevezon, owned by 38-year old Denis Katsyv, totalling US$2.75 million. The purpose of these four wires was described in documents as payments to Prevezon for “bath sets” and “auto spare parts” – goods Prevezon never delivered. Senders to Prevezon account in these four transactions were two Moldovan companies and a BVI company with no known legitimate business activity.

 

These four transactions …were only part of apattern of at least sixty-four wire transfers through U.S. banks amounting to millions more inproperty derived from the Russian fraud and subsequent money laundering,” said Preet Bharara, United States Attorney for the Southern District of New York, in the new filing.

 

In addition to United States Attorney Preet Bharara for Southern District of New York, the case USA v Prevezon is led by four Assistant United States Attorneys Paul Monteleoni, Margaret Graham, Jaimie Nawaday, and Cristine Phillips.

 

“An elaborate fraud against the Russian Treasury resulted in the payment of approximately 5.4 billion rubles to three companies that had been fraudulently misappropriated from the Hermitage Fund, a foreign investment fund,” says the US Department of Justice’s filing.

 

“After the 5.4 billion rubles were paid, a network of shell companies inside and outside Russia laundered these proceeds. Certain of these transfers passed through the United States, either on their way to defendant Prevezon Holdings, or on their way to two other shell companies, Castlefront and Megacom Transit. Four transfers totaling approximately $2.75 million were routed into and out of the United States in this way. These constituted international transportation of stolen property in violation of 18 U.S.C. § 2314,” says the US Government’s filing in the USA v Prevezon case.

 

The further laundering engaged in by Megacom and Castlefront, in sending the funds through another company to Prevezon, and by Prevezon, in investing the funds first in Europe and then into New York real estate, constituted money laundering,” further says the US Government in its filing.

 

A year prior to the US Department of Justice’s action, Swiss General Prosecutor froze about US$7 million on bank accounts connected to Denis Katsyv in Switzerland in a related criminal money laundering investigation into proceeds of the Russian fraud uncovered by Sergei Magnitsky. Denis Katsyv unsuccessfully challenged the decision of Swiss Prosecutor to freeze his accounts in Swiss courts.

 

Sergei Magnitsky, a Russian lawyer, uncovered the largest publicly-known corruption case in Russia involving the theft of $230 million, and testified about it naming complicit Russian officials. He was arrested by some of the implicated officials, held in pre-trial detention for 358 days, and killed in Russian police custody on 16 November 2009.  After Sergei Magnitsky’s death, the Russian government promoted and honoured officials involved in his detention and death.
